    Intellectual Property Law Overview for the Visual Artist

    With Sarah Conley Odenkirk, Esq.

    Join CLA and attorney Sarah Conley Odenkirk for a presentation about intellectual property law in the visual arts.  Topics will include a general overview of copyright, trademark and patent law and a more specific explanation of the role of copyright law in visual arts contracts.

    Presenter:

    Sarah Conley Odenkirk is a fine art attorney in Los Angeles, California. She maintains a private legal practice and is also on the faculty of the Sotheby’s Art Institute’s MA in Art Business at Claremont Graduate University. Sarah is a Council Member for American’s for the Arts’ Public Art Network, and on the Director’s Council for UCLA’s Fowler Museum. She is the author of A Surprisingly Interesting Book About Contracts and maintains a database containing executive summaries and underlying documentation for public art in private development policies and ordinances nationwide.  Sarah is admitted to practice in California, New York, Oregon, District of Columbia and Washington. She is also fluent in French.

    As 3-D printers are becoming more accessible and affordable to the public, the increasing use and availability of 3-D printers will drastically affect intellectual property protection -- especially in the fashion industry. This innovative technology  presents both benefits and detriments to fashion designers. This panel will address the avenues of  intellectual property protection available to fashion designers, the effect and legal implications of 3-D printing technology regarding intellectual property rights, and the enforcement issues surrounding infringement of intellectual property rights.

    1. Brief introduction to 3-D printing (examples of 3-D printed clothing and footwear)

    2. Benefits and Detriments of 3-D printing in the fashion industry

    3. IP protection for fashion designers

    4. Effects of 3-D printing on intellectual property rights

    5. Enforcement issues regarding infringement of IP rights

    Panelists:
    Laura Drossman

    Laura Drossman counsels clients in the fashion, media, branding, and entertainment industries on intellectual property and corporate law issues.  Her practical and creative approach to solving problems helps her clients thrive in today's competitive marketplace while protecting and securing the the value of their intellectual property. Laura is licensed to practice law in California and New York.  She earned her law degree from Tulane University Law School, and earned a BFA in dramatic writing from New York University's Tisch School of the Arts. Prior to private practice, Laura served as a federal law clerk to the U.S. Bankruptcy Court in New Orleans, Louisiana. 


    Rachel Fischbein

    Rachel Fischbein is the founder of Law On The Runway. She is a graduate of Santa Clara University School of Law and licensed to practice law in California. Law On The Runway primarily assists fashion and beauty entrepreneurs by helping them with building the foundations of their companies. Ms. Fischbein holds a bachelor's degree in fashion marketing from Woodbury University. She interned at Organic Exchange, a non-profit which promotes organic fibers and sustainable farming within the apparel industry. She also worked in a sales and marketing role for Trumaker, a startup menswear fashion company. Ms. Fischbein is an active member of the San Francisco Fashion and Merchant Alliance, Digitally Chic, and a registered panel attorney for the California Lawyers for the Arts.


    Moderator:

    Ms. Brodskaya counsels clients in intellectual property law, including IP strategy, portfolio development, trademark, copyright, and related transactions and disputes. Ms. Brodskaya developed significant experience in her previous roles at Louis Vuitton North America, Inc. and Silver Starr Art Studios, an entertainment consultancy, in New York City, in product branding and brand management, trademark and copyright portfolio development, and enforcement of intellectual property rights in the fashion, consumer product, and entertainment industries.

    CLA is a State Bar of California approved MCLE provider.

    Publishing Contracts and Overview of Intellectual 
    Property Issues in Publishing 
    [5.0 hrs. California MCLE credit available]
    With Jonathan Kirsch, Esq. and Paul Levine, Esq.

    Join CLA for an extended length program covering the intricacies of literary publishing contracts. The day will begin with a presentation by attorney Jonathan Kirsch, who will discuss the standard components of a publishing deal with a focus on real world examples from sample agreements. The presentation will also address recent changes in practices due to developments in law, technology, and publishing markets.

    After a half hour break, attorney Paul Levine will provide an in depth look at four of the most common compensation arrangements for authors: advances, royalties, first and second serialization rights and best-seller bonuses. The presentation will cover the way these arrangements are typically structured as well as the pros and cons of each model.

    This program will be presented at an advanced level and is geared towards attorneys, but all members of the community are welcome to attend.


    Presenters:

    Jonathan Kirsch, Esq. is a publishing and intellectual property 
    attorney based in Los Angeles, an expert witness on publishing 
    industry matters, an Adjunct Professor on the faculty of New York 
    University’s Professional Publishing Institute, and a lecturer and 
    consultant on publishing matters.

    Kirsch’s books include Kirsch’s Handbook of Publishing Law and 
    Kirsch’s Guide to the Book Contract, both of which are now in 
    revision for a new and updated single-volume edition from Silman­ James Press.

    Kirsch is also the book editor of The Jewish Journal, a longtime 
    book reviewer for the Los Angeles Times, and the author of 13 
    books of history and biography, including the newly published The
    Short, Strange Life of Herschel Grynszpan: A Boy Avenger, a Nazi
    Diplomat, and a Murder in Paris (W. W. Norton/Liveright).

    Paul S. Levine,
     Esq. wears two hats: he is a lawyer and a literary
    agent. Mr. Levine has practiced entertainment law for over 30 years,
    specializing in the representation of writers, producers, actors,
    directors, composers, musicians, artists, authors, photographers,
    galleries, publishers, developers, production companies and theater
    companies in the fields of motion pictures, television, interactive
    multimedia, live stage, recorded music, concerts, the visual arts,
    publishing, and advertising. Since starting his literary agency, Mr. 
    Levine has sold over 100 adult, young adult, and children’s fiction 
    and nonfiction books to at least 50 different publishers and has had
    many books developed as movies for ­television and feature films.

    Introduction to Copyright Law: Legal Protection of Creative Works 

    with Gary Goldberger, Esq.


    Program Description

    You've written, developed, drawn, painted or produced a creative work.  Now who owns the work and controls the right to exploit it?  This workshop will provide an overview of the copyright law in the United States as it relates to the arts and entertainment industries.  Topics to be discussed will include the purpose of copyright law, what it applies to and what it doesn't apply to, rights conferred by copyright, works-made-for-hire and works created as an employee, fair use, copyright reversion, sharing of copyright, and licensing of rights.

    About the Presenter

    Gary Goldberger operates a solo law practice in which he focuses on transactional entertainment law, new media law, and general business law. He is able to combine his experience in legal, business, creative and international areas to help his clients make decisions not just from a legal standpoint, but also from a strategic and long-term perspective. Clients include production/distribution companies, growing small to mid-sized companies, independent filmmakers, documentarians, publishers, talent, screenwriters, book authors, musicians and music-related businesses, and Internet and new media businesses. 

    Goldberger is a board member of California Lawyers for the Arts, and is the Vice President of the Encino Lawyers Association.  Goldberger served for two terms as a Governor of the Academy of Television Arts and Sciences, and was Chair of ATAS' Sponsorship Committee for four years.  In addition to continued membership in the TV Academy, he is also a member of the British Academy of Film and Television Arts-Los Angeles.

    Goldberger is a 1976 graduate of the Wharton School of the University of Pennsylvania, and received his J.D. degeree from the University of Virginia School of Law in 1979.

    MUSIC LAW ESSENTIALS SERIES:
    Contract Fundamentals in the Music Industry
    With Daniel Schacht, Esq.

    Join Daniel Schacht and Robert Walker of Donahue Gallagher Woods for a discussion of the fundamentals of contract law in the music business. Analyzing real record label and music publisher agreements, this workshop will cover the basic requirements of contract formation, the different parts of a contract, common terms and provisions found in music business deals, different types of licenses and assignments, and more.   

    Presenters:
    Daniel J. Schacht is an attorney at Donahue Gallagher Woods LLP, specializing in intellectual property, technology, and music law. He handles a variety of copyright, trademark, licensing, employment and general business matters for artists such as Carlos Santana, Journey, and Amon Tobin. He currently serves as co-counsel in Good Morning to You Productions Corp. et al. v. Warner/Chappell Music, Inc., the "Happy Birthday" class action lawsuit described by the New York Times as "a lawsuit for the ages." Before law school, Mr. Schacht worked ten years in the Bay Area music scene as a bassist, sound engineer, studio owner, and producer.

    Robert K. Walker is an associate with Donahue Gallagher Woods LLP, specializing in intellectual property and business law, with an emphasis on copyright, entertainment, and technology law. Before law school, Mr. Walker worked as a video producer, director, and editor for CNNMoney.com and TVGuide.com, and as a technology project manager for Condé Nast Publications and other companies. While at CNN, he was a member of the production team that won a 2008 Peabody Award for distinguished public service in broadcasting.

    Life Cycle of a Public Art Project
